Spousal support can be one of the most contentious issues in divorce. No spouse wants to pay spousal yet reality says the other spouse may need support and be entitled to it. Mediation can help a couple understand when spousal support is appropriate, what the high and low amounts may be, and when it may be in the best interests of both parties for one person to return to school or get job training to enhance employment opportunities following the divorce.
Temporary and long term spousal support are issues that can be resolved through mediation. Mediation will assist parties in knowing when long term support is appropriate, what a fair amount may be and for how long support will continue. Mediated settlements can include solutions to a wide variety of financial circumstances, both presently and in the future. A solution could include more support now in exchange for less support later, a “step-down order” to reduce or eliminate support after the recipient has secured a job, or a variety of other solutions which would only be possible in mediation.
During mediation, parties will typically be offered an opportunity to review “what if” scenarios, where different amounts of support are used in order to make decisions about how spousal support will work. Spouses typically work well with the mediator – and with each other – after seeing the hard numbers and the calculations of after-tax, spendable income for each party under a variety of assumptions and support amounts. We will work hard to produce effective dialog between the parties to achieve an order which is fundamentally fair and each party can live with.
