Mediation could be a solution for same-sex divorce

As of this summer, same-sex marriage is legal again throughout the state of California. The U.S. Supreme Court’s ruling in June effectively put an end to the state same-sex marriage ban, so all couples can now have their marriages recognized.

As many Californians are just beginning to celebrate their lives together, divorce may not be the first topic that comes to mind. However, civil marriage offers a number of legal protections, and the ability to divorce is one of them. Without a legally recognized marriage, couples who spent years together had no clearly defined way to end their relationship and untangle their assets, which created significant hardships.

Divorce provides a legal framework for couples to split up multiple aspects of their lives. Anyone who has been through a divorce knows that it can get stressful and contentious at times. As such, couples may be looking for ways to ease the process and dicorce mediation could be a viable option to accomplish that.

By choosing mediation, a divorcing couple can come together in a collaborative environment to work through sources of tension with the assistance of legal counsel. The reality is that many same-sex couples may find themselves with complex issues to solve, especially if they were together for several years before having the ability to legally marry. A divorce mediator may be able to provide effective and thoughtful ways to reach a fair settlement.

The complete impact of the Supreme Court’s same-sex marriage rulings will continue to be seen over the next few years. In the meantime, many Californians can take comfort in protections offered by the changes in family law.
